SC DUI Requirements for Blood Tests

There are three ways that Myrtle Beach, S.C. police can obtain evidence of a driver’s blood alcohol content: the breathalyzer, urinalysis, or a blood sample. Salt Lake City Detective Jeff Payne’s meltdown when a hospital nurse refused to allow him to draw blood from a patient was made public after the nurse released footage of the officer verbally abusing, assaulting, and arresting her. The officer did not have authority to draw blood from the patient. The patient was not even a suspect in a crime – he was driving a truck when he was struck head-on by another car that was being chased by a police officer. 

The nurse can be seen in the video calmly explaining to the officer that his department had an agreement with the hospital to only draw blood from patients when 1) the patient was under arrest; 2) the officer obtained a warrant based on probable cause; or 3) the patient consents. The patient was not under arrest, the officer did not obtain a warrant, and the patient was unconscious and unable to consent. The officer admits on the recording that there was no probable cause for the warrant. He is a trained phlebotomist, paramedic, and police officer who was familiar with the requirements for drawing a patient’s blood. South Carolina’s felony DUI statutes do authorize police to take a blood sample without consent whenever there is suspicion of DUI and an accident that results in injury or death. 

This provision is unconstitutional in light of the United States Supreme Court’s 2013 decision in Missouri v. McNeely which held that police must obtain a warrant or consent except when there are exigent circumstances that would make it impossible for the officer to obtain a warrant. The Court specifically found that the dissipation of alcohol in the bloodstream is not an exigent circumstance that would justify forcing a blood draw without a warrant. If police drew blood without first obtaining a warrant or consent and if there are no exigent circumstances that would justify the warrantless blood draw, you may be able to have the evidence excluded at trial.

Charleston high school teacher on administrative leave following DUI arrest

SUMMERVILLE, S.C. – Whitney Brooks, the suspect involved in a fatal collision with an off-duty North Charleston police officer, is currently on administrative leave from Burke High School. Whitney Brooks is charged with felony driving under the influence involving death following a two-vehicle collision on Ladson Road near Henrietta Ave on Thursday. We’re told the Charleston County School District is aware of Brooks’ charge. The District says it has no further comment on the matter. Meantime, Brooks is expected to face a bond court judge at 3 p.m.

The mission of the Administrative Law Court is to provide a neutral forum for fair, prompt and objective hearings for any person affected by an action or proposed action of certain agencies of the State of South Carolina. The Administrative Law Court is an autonomous quasi-judicial agency within the executive branch of state government. The Court was created by the South Carolina General Assembly by Act No. 181 of 1993, to provide an independent forum for hearing the contested cases of state agencies. Mount Pleasant SC girl missing in Berkeley County, left note

A 15-year-old girl from the Charleston area has reportedly been missing from her home since Thursday. Amber Thurlow is 5-foot-5, weighs about 110 lbs, has brown hair and hazel eyes, according to Mount Pleasant Police Department. Police are searching for the girl alongside Berkeley County Sheriff’s Office, Live 5 News in Charleston reported. Thurlow reportedly left a note for her family saying she would be gone for a few days and would be safe, but she didn’t say where she was going or with whom. In her note, the teen also reportedly asked her mother not to contact police because she did not want to get in trouble, ABC News 4 reported. She was last seen wearing black leggings and a gray sweatshirt. Anyone with information can call Berkeley County Sheriffs Office at 843-719-4465.

Bicycle Ride Honorees Include DUI Victim

Dozens of firefighters, police officers, and emergency personnel make up the cycling group known as The Carolina Brotherhood. Over the span of 6 days, the group covered the 625 miles from Smithfield, North Carolina to Beaufort, South Carolina for the purpose of honoring their fallen brothers and sisters who lost their lives in the line of duty from the Carolinas. On June 15, 2017 at 5:00 pm, battling temperatures in the high 90’s, the group pulled into Anderson, SC where fallen firefighter Kenneth Stanton was honored. Kenny was killed by a drunk driver on February 15, 2015 while working a crash with the Sandy Springs Fire Department. Kenny’s family and friends cheered as the riders were escorted in by Anderson County Sheriff’s Office, Fire and EMS as they passed under the American flag hanging from the aerial ladder of a firetruck. Kenny Stanton’s service and sacrifice will never be forgotten.

State Trooper Cruiser Hit, Man Charged with DUI

CHARLESTON, S.C. A South Carolina man is charged with driving under the influence after authorities say he crashed into a highway patrol vehicle that was stopped on the side of an interstate. Multiple media organizations report that 27-year-old Michael Hazel of Goose Creek was charged after the Charleston County crash around 2 a.m. Sunday. The Charleston County Sheriff’s Office says Hazel’s vehicle slammed into the back of a State Trooper’s cruiser that was stopped alongside Interstate 26. Highway Patrol Sgt. Bob Beres says the trooper was out of his vehicle investigating another wreck and wasn’t hurt. Hazel suffered minor injuries and was treated at a hospital before being taken to jail. Hazel later posted a $10,000 bond and was released from jail.

Police Misconduct: A Preponderance of Perjury

Many commission reports prove rampant abuses in police departments throughout the United States Judges and prosecutors tolerate if not encourage police lying in court all in the name of convicting the factually guilty.
