WTAT-TV/DT » Former Ashley Ridge Quarterback Victim of Fatal DUI Crash

WEST ASHLEY, SC – Charleston County deputies have charged a 23-year-old man with a felony DUI following a deadly crash over the holiday weekend. Deputies say Lorenzo Baker was speeding when he crashed in West Ashley at the intersection of Ashley River Road and Wappoo Road early Sunday morning. Authorities say an empty Bud Light can was found on the floor of the driver’s side and an empty Bud Light box was also found in the car. They believe Baker was speeding when he lost control of the vehicle and hit a tree stump. 23-year-old Charles Cox was the passenger and the coroner says he died at MUSC. We have learned that Cox was a former quarterback at Ashley Ridge High School.

What Are The Consequences of a Felony DUI in SC?

Let’s explore what’s involved when someone is charged with a felony DUI in SC. Felony DUI in South Carolina is when a person who is impaired by alcohol or drugs causes death or serious injury to another motorist or a passenger in their own vehicle. These are complex cases and it is critical that a felony DUI defendant retain experienced DUI defense counsel as soon as possible after the accident even if the arrest has not yet happened. Felony DUI with great bodily injury carries a mandatory minimum sentence of 30 days up to 15 years in prison, and a mandatory fine of $5100 up to $10,100. The court cannot suspend the sentence in either case, and probation is not an option. 

They must keep an ignition interlock device in their car for three years for felony DUI with great bodily injury or five years for felony DUI where death results. Under South Carolina law a felony DUI defendant cannot refuse the breathalyzer or blood draw. In felony DUI cases, law enforcement investigators and prosecutors will put much more effort into obtaining evidence than they would in an ordinary DUI case. The defense will need to examine not only the defendant’s medical records but also any medical records of the alleged victims to determine whether the accident was the cause of death or whether the victim’s injuries were severe enough to warrant a felony DUI charge. The Highway Patrol MAIT team will conduct their own investigation but, in many cases, it will be critical that the defense retain an independent accident re-constructionist to determine the circumstances and cause of the accident.

Avoiding Police Checkpoints and DUI. Because you’ve had a few drinks, you think about if you’re safe to drive home. The South Carolina Highway Patrol set up a checkpoint at the bottom of a hill. When Williams saw the checkpoint, he made a U-turn and headed back the other way. As a result, Trooper Robertson saw the U-turn and pursued Williams. 

After going through field sobriety tests, the trooper charged Williams with DUI. During trial, Williams argued that the checkpoint was unConstitutional and that his U-turn was legal. Because the court found the checkpoint defective, the case turned on whether the U-turn was proper. On appeal, the circuit court agreed the invalid checkpoint voided the stop and arrest. The Court of Appeals reversed holding a checkpoint analysis only applies if stopped there. 

The U-turn did not matter because police only need reasonable suspicion to stop. Due to the suspicious circumstances, the stop and arrest Williams was proper. While most Charleston DUI lawyers will disagree with this case, it is the law. Police almost always think you are avoiding police checkpoints and chase you down.

Individuals who are convicted of driving under the influence Individuals who are referred by the South Carolina Department of Natural Resources for boating under the influence Individuals whose licenses are suspended through the state’s Administrative License Revocation procedure. An individual also is subject to ALR if he refuses to take a blood, breath, or urine test for the presence of alcohol and other drugs. MUST HAVE a 10 year driving record or proof of DUI conviction Valid form of picture ID Any prescription medications. Because thousands of South Carolinians are killed or injured each year in alcohol or other drug-related crashes, ADSAP works with offenders to reduce the number of crashes that result in death, injury, or property damage. South Carolina law requires a person whose driver’s license has been suspended as the result of a DUI conviction, ALR, or Zero Tolerance Suspension to successfully complete an ADSAP before he or she can apply to the South Carolina Department of Public Safety for reinstatement of his or her drivers license. 

The SCDPS will not consider reinstatement until it receives notification of successful completion of the program. ADSAP services are certified by the South Carolina Department of Alcohol and Other Drug Abuse Services and are available in each of the state’s 46 county alcohol and drug abuse authorities. Education groups are offered weekdays, weeknights and weekends. Treatment Groups are offered weekdays and weeknights.

Substance Abuse and Addiction Treatment Services

The SC DMV will not consider reinstating your driver’s license. If you were convicted after February 10, 2009 and you failed to enroll in ADSAP within 30 days of conviction, you will be held in contempt of court. Upon your enrollment, you will expected to participate in an evaluation to determine problems that most likely contributed to your DUI. You will work with a clinician to develop goals and participate in education and/or treatment. The time period for ADSAP varies for each participant. 

Individuals usually complete services by the end of their suspension period. The cost for educational services provided through ADSAP is $500. However, fees for any treatment services required by the program vary and can cost up to $2000. First-time DUI offenders who meet certain requirements may obtain a provisional driver’s license from the DMV:. You must have had a valid SC driver’s license at the time of your violation. 

Your driver’s license must not be suspended for any other reason. You must provide proof of SR22 insurance to the DMV. You must enroll in ADSAP and make satisfactory progress. Enroll in SC ADSAP and follow treatment recommendations. You may finish services in another state: please refer to Interstate Alcohol and Drug Safety Action Program Please note that a provisional driver’s license is no longer valid when you move out of state. 

You may be eligible for a SC provisional permit if you enroll in SC ADSAP, meet the provisional driver’s license requirements and maintain a valid out-of-state license.

We’re not only South Carolina motorcycle accident attorneys, but we’re also avid riders-and the Northeast has some of the most beautiful motorcycle routes in the country. With its rolling hills, picturesque shoreline, and quaint towns, Connecticut is a perfect getaway for everyone, and it has some lovely scenic route and loop tours. This 50-mile scenic route begins in Litchfield, CT and moves west on US 202 through Bantam and New Preston, at which point you’ll turn north on East Shore Road and go toward Warren. You’ll find woodlands, lakes and streams, and waterfalls along the route, and if you’re a history buff, you’ll love the historical towns with their stately colonial mansions. You’ll enter CT on Route 165, turn right on Route 49, and again turn right on Route 14A to head to Sterling and Oneco. 

This route takes you through the largest state forest in Connecticut, the beautiful 24,000-acre Pachaug State Forest near Voluntown. This 102-mile route begins near Granby, CT, at the intersection of Routes 20 and 202. You’ll take Route 20 west into Winsted, then turn on Route 44 and continue west to Canaan and Lakeville. Pick up Route 7 and ride south along the Appalachian Trail to New Milford, and then if you choose, turn onto 45 North and head back to Canaan. This route is popular with tourists, so you may wish to explore this in the off-season. 

Throughout the ride, you’ll find plenty of state parks, museums, and quaint towns to explore, as well as many places to stay and shop, especially along Route 7. The Appalachian Trail has scenery like no other, and much of the ride is along designated scenic routes.
