Today, the Charleston County Sheriff’s Office is one of the largest full-service Sheriff’s Offices in the State of South Carolina. Charleston County is South Carolina’s seventh largest county geographically and its third-most populous. As a political subdivision, Charleston County has been in existence since 1682, as one of three original counties in South Carolina. The agency is proud to be internationally accredited by the Commission on Accreditation for Law Enforcement Agencies, the American Corrections Association, and the National Commission on Correctional Health Care reflecting the commitment of the Sheriff’s Office to continually improve the quality of law enforcement service provided to the citizens of Charleston County. COLUMBIA – The SC Department of Public Safety recognized law enforcement officers and agencies Tuesday for their efforts in 2013 to enforce the state’s DUI laws and remove impaired drivers from South Carolina roadways. 

SCDPS presented awards to officers and agencies in several categories and held drawings for agencies to win equipment and vehicles during the 9th Annual DUI Enforcement Recognition and 2013 Law Enforcement DUI Challenge Ceremonies. Several agencies qualified to draw for one of 20 digital in-car video systems or two fully equipped police vehicles to use in DUI enforcement efforts. Nominated officers were recognized as DUI Heroes and will receive pins in bronze, silver or gold to honor their DUI arrest accomplishments in 2013. State law requires all South Carolinians who are convicted of DUI to successfully complete the department’s ADSAP before they can be eligible for relicensing by the S.C. Department of Public Safety. 

The ultimate goal of the program is to improve highway safety by providing assessment, education, intervention, and treatment services for DUI offenders in an effort to reduce their risk of committing another DUI in the future. First time DUI offenders in South Carolina will be required to complete a 20 hour DUI education class. Our 20 hour DUI class costs $329 and can be taken by anyone who has been preapproved to take an online class.

How Much Jail Time Can I Get for DUI in SC

What is ADSAP and why you should care after a DUI?

Individuals who are convicted of Driving Under the Influence or driving with an unlawful alcohol concentration which equates to a blood alcohol concentration of.08% or greater. For a list of ADSAP treatment providers see: List of ADSAP Treatment Providers. A person convicted of violating this section, whether for a first offense or subsequent offense, must enroll in and successfully complete an Alcohol and Drug Safety Action Program certified by the Department of Alcohol and Other Drug Abuse Services. An assessment of the extent and nature of the alcohol and drug abuse problem of the applicant must be prepared and a plan of education or treatment, or both, must be developed for the applicant. The Alcohol and Drug Safety Action Program shall determine if the applicant successfully has completed the services. 

The applicant must attend the first Alcohol and Drug Safety Action Program available after the date of enrollment. The Department of Alcohol and Other Drug Abuse Services shall determine the cost of services provided by each certified Alcohol and Drug Safety Action Program. Each applicant shall bear the cost of services recommended in the applicant’s plan of education or treatment. The cost may not exceed five hundred dollars for education services, two thousand dollars for treatment services, and two thousand five hundred dollars in total for all services. An applicant may not be denied services due to an inability to pay. 

Inability to pay for services may not be used as a factor in determining if the applicant successfully has completed services. An applicant who is unable to pay for services shall perform fifty hours of community service as arranged by the Alcohol and Drug Safety Action Program, which may use the completion of this community service as a factor in determining if the applicant successfully has completed services.

On June 2nd, a bill was signed into law that will stop the solicitor’s offices from charging a fee to expunge records where the person was found not guilty or where the charges were dismissed. In exchange for an expungement service that is provided by the solicitor’s office, the applicant is responsible for payment to the solicitor’s office of an administrative fee in the amount of two hundred fifty dollars per individual order, which must be retained by that office and used to defray the costs associated with the expungement process, except as provided in subsection. The two hundred fifty dollar fee is nonrefundable, regardless of whether the offense is later determined to be statutorily ineligible for expungement or the solicitor or his designee does not consent to the expungement. B) Any person who applies to the solicitor’s office for an expungement of general sessions charges pursuant to Section 17-1-40 is exempt from paying the administrative fee, unless the charge that is the subject of the expungement request was dismissed, discharged, or nolle prossed as part of a plea arrangement under which the defendant pled guilty and was sentenced on other charges. This bill decreases the time limit for an expungement under the Youthful Offender Act from 15 years to 5 years.

SC woman charged with DUI in crash that killed 2, hurt 4 kids

A South Carolina woman is facing felony DUI charges after a weekend crash that killed two people and injured six others, including four children who were not wearing seat belts. Khelsy Chanta Rice, 38, of Clinton, was charged Monday with two counts of felony DUI resulting in death, three counts of felony DUI resulting in great bodily injury and one count of child endangerment, according to Laurens County online court records. Rice also faces a charge of open container, according to media reports. A booking photo of Rice was not available Tuesday morning. Troopers say Rice was driving the Ford Taurus that crossed the center line on U.S. 76 and hit a Ford Mustang head-on late Saturday, killing 63-year-old Lois King and 65-year-old Marge Seymore, both of Clinton. 

King and Seymore were airlifted to area hospitals, where they later died. A third person in the Mustang was airlifted to a hospital. Rice, who was wearing a seat belt, had to be extricated and was taken to Greenville Memorial Hospital. Four children who were in the Taurus with her also were taken to Greenville Memorial with unknown injuries. None of the children were wearing seat belts, troopers said. 

The three women had just left an Elvis impersonator concert at the Newberry Opera House and were two miles away from their destination when the crash happened, she told the TV station. Rice faces up to 25 years in prison on each of the felony DUI resulting in death charges and up to 15 years on each of the felony DUI resulting in great bodily injury charges.

South Carolina: LORENZO JAQUANE BAKER, 23, was charged by Charleston County Sheriff’s Deputies with felony DUI for killing Cameron Cox

Charleston County Sheriff J. Al Cannon, Jr. At 1:22 a.m., Jan. 1, 2017, Charleston County Sheriff’s deputies reportedly responded to a single car collision on Ashley River Road near Wappoo Road. Police said that responding deputies reported finding a beer can on the floorboard of the driver’s side and an empty beer box inside the car. A report states Baker was in and out of consciousness as he spoke to a deputy. 

The deputy said he could smell a strong odor of alcohol coming from Baker and advised him that he was under arrest. CCSO officials said the accident began when a white Buick Park Avenue was traveling northbound on Ashley River Road at a high rate of speed.

Instead, under the established procedures, Judge Mendelsohn would be transferred to the Charleston County Detention Facility where he would remain until a bond hearing could be held the next morning at approximately 8:00 a.m. Judge Mendelsohn knew the Mount Pleasant procedure was not the same procedure used in Charleston for DUI cases. Respondent, who was familiar with the procedure used in Charleston, asked the lieutenant why Judge Mendelsohn could not be released. After the lieutenant explained Mount Pleasant’s bond procedure, respondent remarked that he would go to the bond court and conduct a bond hearing for Judge Mendelsohn that night. Respondent asked that Judge Mendelsohn be brought directly to bond court rather than first being booked into the detention center. 

The lieutenant then advised the arresting officer that respondent would be at the Charleston County Detention Center to conduct a bond hearing. During the conversation, respondent and the Summary Court Director discussed that if a bond hearing was held at other than normal operating hours, respondent would be required to hold a bond hearing for all incarcerated defendants. Respondent met the arresting officer and Judge Mendelsohn at the detention center. Respondent acknowledges it was his intention to facilitate Judge Mendelsohn’s release without waiting for the morning bond hearing and to make it appear that Judge Mendelsohn’s bond was set at 8:00 a.m. in accordance with Mount Pleasant’s bond procedure. 

Respondent communicated his setting of the bond to the Mount Pleasant Chief Judge and asked the judge to indicate his approval of the bond. The Mount Pleasant Chief Judge called the Charleston County Detention Center and was advised that officers were in possession of a valid bond set by respondent. Judge Mendelsohn was released from the Charleston County Detention Center at approximately 2:30 a.m. Contrary to the published directives of the Chief Justice, respondent did not undertake to set bonds for the other detainees in the detention center. Combined with respondent’s favoritism towards Judge Mendelsohn and his racial remark, the Court deems a public reprimand appropriate.
