YouTube Confessor Gets 6 ½ Years for Felony DUI

An Ohio judge has sentenced a man who confessed his crime on YouTube to 6 years in prison on felony DUI charges. On Wednesday, October 23rd, Franklin County Judge David Fais sentenced 22-year-old Matthew Cordle, whose YouTube confession to killing a man while driving drunk went viral over the summer, to 6 years for aggravated vehicular homicide, and 6 months for driving under the influence of alcohol. By Ohio state felony DUI law, Cordle’s driving privileges were revoked for life. Cordle could have received up to 8 years for the death of Vincent Canzani, 61, in the June 22nd crash. When police tested Cordle’s blood alcohol content at the scene of the crash, it was 0.19%, more than twice the legal limit of 0.08%.

At his September 3rd hearing, Cordle pleaded guilty to felony DUI and has been in jail since then. The victim’s family had mixed reactions to Cordle’s internet confession. Cheryl Oates, Vincent Canzani’s wife, says that she believes Cordle should spend time in jail, but she thinks his remorse is genuine. Canzani’s daughter Angela has said that she does not think it is fair for a person who commits manslaughter due to felony DUI to simply apologize and get some leniency. During the sentencing hearing, Cordle read a statement from a folded yellow piece of paper.

Upon conviction of a felony DUI by jury, the accused faces a minimum mandatory prison sentence and fine. If you face felony DUI charges in South Carolina, we can help. Do not let DUI or felony DUI charges prevent you from pursuing opportunities.

Reviews for DireFreights in north Charleston ,SC

Drivers who join CitizenShipper are screened for a variety of criminal offenses and driving incidents. We utilize a reputable leader in screening called Single Source Services to perform our criminal background screening which includes national, county level and sex offender databases. The background screening we utilize is called the ‘Discovery National’. The background screening includes a residence trace and returns all names and addresses associated with a social security number, in addition to checking the alias(es) returned through the database and the sex offender data. Based on the subject’s name(s) and date of birth the data returned from the background screening are records from State Departments of Correction, State Record Repositories, County Courts, and sexual predator/violent offenders’ databases from all 50 states, DC, Guam, and Puerto Rico.

Although this search has great value, and the volumes and sources of data are increasing almost every day, it is not an FCRA compliant service. The data is not updated after being entered into the database and therefore records could be expunged, sealed, or verdicts could have been appealed. While we believe that the Discovery National is a good foundational screening tool, it is not an exhaustive statewide search of records, and as such we cannot guarantee 100% effectiveness in screening candidates.

South Carolina’s “Sober or Slammer” DUI Crackdown During the Holidays

Notice to all South Carolina drivers: The holidays are here and that means the office holiday, Christmas and New Year’s party season is in full-swing. As a result, the number of impaired drivers on our roads will be increasing exponentially over the next several weeks. In response to the statistically proven uptick in drunk driving during the holiday season, the state has reintroduced the Sober or Slammer campaign. According to the South Carolina Department of Public Safety, the Sober or Slammer program is statewide DUI enforcement, public information and education campaign. The SOS program’s goal is to reduce alcohol related accidents, injuries and deaths through a decrease in impaired driving.

State and local law enforcement agencies, including those in Charleston and Berkeley Counties, will join forces to accomplish the program’s objectives. The enforcement efforts also include a public education campaign regarding the severe consequences of an arrest for DUI. Keep an eye out for Sober or Slammer commercials over the next month. Miller|Conway strongly urges you to refrain from drinking and driving. Please call a cab or institute a designated driver policy.

Driver In NYC Tour Bus Crash Arrested for DUI

The driver of a double-decker tourist bus in New York City has been arrested on DUI charges after causing a bus crash with another tour bus late on Tuesday night. The tour bus crash occurred around 8:30 PM on Tuesday evening. A Gray Line bus, carrying five passengers and a tour guide, came to a legal stop with its lights flashing, when the CitySights bus – which only had the driver and a tour guide on board – crashed into the right rear of the Gray Line bus. The tour bus crash caused the Gray Line bus to jump onto a side walk and knock over a light pole, injuring several pedestrians. William Dalambert, 58, was arrested on DUI charges after failing a field sobriety test.

While a Breathalyzer test did not register any alcohol in his blood stream, arresting officers said the driver was clearly impaired, and was taken to jail for a blood test. Driving under the influence, whether it is from alcohol or drugs, is a serious offense in all 50 states. DUID charges in South Carolina can lead to jail time and fines, and injury along with a DUI can lead to felony charges. A car accident can transform a routine drive into a life-changing catastrophe. Every year, thousands of drivers end up in a South Carolina car wreck, and on average about 800 of them will lose their lives.

Summerville police: Charleston County deputy arrested for DUI

Summerville police arrested a DUI suspect who they later learned is employed by the Charleston County Sheriff’s Office. According to a Summerville Police Department report, 26-year-old Edward Clemens was found asleep at the wheel of a 2011 Chevy Silverado at the intersection of West Carolina Avenue and 5 Points around 4 a.m. Sunday. Charleston County Sheriff’s officials said Deputy Clemens has been with the department since December 12, 2014. He was assigned to their patrol division and has been placed on administrative leave with pay.

A Summerville officer on patrol said he saw the truck sit through two cycles of a red light, walked up to the window and knocked on it several times to wake up Clemens. When he finally woke up, the police officer opened the driver’s side door but Clemens’ foot reportedly left the brake pedal so the truck started to roll forward. The Summerville officer said he had to ask Clemens several times to stop his truck and when he finally did, the officer said he could not only smell alcohol on his breath but he had slurred speech and bloodshot eyes. His story changed later when he admitted to having two beers. The responding officer said Clemens had a hard time providing documentation, handing over a debit card when asked for identification and failing to see his registration card at first.

Clemens reportedly got out of the truck but had to use his shoulder for support in order to stand. Officers confiscated Clemens’ firearm and charged him with driving under the influence. Clemens refused both the field sobriety test and the breathalyzer.

Mr. O’Neill served as chairman of The Committee of The Charleston County Bar Association to establish a Mediation pilot project in Charleston County. As our Charleston accident lawyers at Howell and Christmas know, the injuries and damages from a serious car crash can be deadly. Firstly, and perhaps most significantly, in order to receive punitive damages in a personal injury claim, it must be specifically prayed for in the complaint. If the plaintiff requests punitive damages then a defendant may request two separate verdicts regarding, damages, one for compensatory damages and one for punitive, called a bifurcated trial.

Firstly, the jury must determine whether or not compensatory or nominal damages are appropriate. If compensatory or nominal damages are awarded, the jury must determine whether punitive damages are appropriate. If a jury finds that punitive damages are appropriate, it can award an amount up to three times the amount awarded during the compensatory damages determination, or $500,000, whichever is greater. The defendant has pled guilty to or been convicted of a felony arising out of the same act or course of conduct complained of by the plaintiff and that act or course of conduct is a proximate cause of the plaintiff’s damages; or. If the defendant intended to harm and actually did harm the plaintiff, then there is no cap to punitive damages.

If the compensatory damages are high, the punitive damages can be high regardless. A similar award to the $25 million punitive damages in Florida award could be upheld in South Carolina under the current legislation. Contact your South Carolina drunk driving defense lawyer online today to find out how we can help limit the damage of a criminal DUI charge.

ACT QUICKLY TO PREPARE A DEFENSE: There is a very limited time frame to develop a compelling defense on Felony DUI death charges. Police arriving at the accident scene evaluate the severity of the injuries and will often call in their own experts to reconstruct the accident. Felony DUI cases are normally investigated by the SC Highway Patrol’s accident investigation team, known as MAIT. MAIT is the Multi-Disciplinary Accident Investigation Team that assists law enforcement agencies, and they normally provide in-depth investigations and/or reconstructions to determine the exact events of the collision. MAIT’s ultimate objective is to be the fact finders so decisions can be made as to the charges and causes of an accident.

A conviction for Felony DUI involving death requires the Defendant to actually serve eighty-five of the prison sentence. We can employ our own experts to examine the accident scene, look at the car damage and interview witnesses. We routinely employ former traffic supervisors as case analysts who themselves have investigated accidents involving felony DUI during their careers as law enforcement officers. We utilize the services of veteran accident re-constructionists who have retired and are now working independently as experts in their fields. Their expertise combined with our experience in defending felony DUI arrests creates a highly capable defense team to work for you.

Arrested for DUI in Charleston, Berkeley or Dorchester?

If your vehicle has been towed, you will need to follow the local arresting agency’s particular policy for the release of any vehicle. Often times, officers from multiple agencies, such as local deputies and state troopers will play separate rolls in an arrest and documents don’t get passed along. We prefer to meet with each client individually and gather a very, very detailed description of the events before, during and after the arrest. Please realize that we know exactly how an officer should handle a DUI arrest in particular circumstances, whether it be a traffic stop, a checkpoint, a single or multi-car accident. We are often looking for things that you or your witnesses can either confirm took place or deny, which are extremely important to an arrest.

This is why you need an experienced DUI attorney who has handled hundreds of DUI arrests. Remember, the police report is the Arresting Officer’s version of the events of the evening. Police officers will include most everything that supports their arrest and very little or nothing favorable to the Defendant. The requirements and law regarding the sequencing of events during an arrest are constantly being refined and further detailed by the South Carolina Courts. Once retained, we will also serve the Arresting Officer and each agency involved with a Discovery Motion designed to examine any and all evidence they intend to use against you in their prosecution of the DUI charge.

Remember, each and every DUI Arrest is different and each client’s dialogue which is caught on police video and recorded is different. Each individual arrest is different from any other, with differing officers, agencies, facts, evidence and witnesses.

Who is the Best Criminal Defense Lawyer in Charleston, SC?

I don’t consider myself to be the best criminal defense attorney in South Carolina or even in Charleston, although that is what I strive for every day, in every client’s case. Most claims, information, or reviews that you see on the internet about any attorney are going to be written by or written on behalf of an attorney – an attorney who wants you to hire them. Spend some time researching local attorneys, their backgrounds, and their reputation. Check with the SC Bar to see if the attorney has been publicly disciplined. Talk to former clients if possible – keeping in mind that no attorney will have all happy clients, you can still get a sense of what the attorney is like and how they treat their clients.

Any attorney can take on any type of case in South Carolina. Do some research and choose at least two or three local attorneys that look promising, then go meet with them and talk to them. If the attorney charges an initial retainer with an hourly rate or a contingency-type fee, you are probably not talking to a criminal defense attorney. Some of the best criminal defense lawyers keep a small caseload and don’t use office staff – although an attorney with no office staff may give you pause, it is only one of many considerations you should have. The best attorney in the world is only as good as their office staff.

Regardless of what they claim on their website, they are not connecting you with the perfect attorney for your type of case. There is nothing special or personal about it at all, and it’s useless unless you just want a random selection for your attorney.

SC woman charged with DUI in crash that killed 2, hurt 4 kids

A South Carolina woman is facing felony DUI charges after a weekend crash that killed two people and injured six others, including four children who were not wearing seat belts. Khelsy Chanta Rice, 38, of Clinton, was charged Monday with two counts of felony DUI resulting in death, three counts of felony DUI resulting in great bodily injury and one count of child endangerment, according to Laurens County online court records. Rice also faces a charge of open container, according to media reports. A booking photo of Rice was not available Tuesday morning. Troopers say Rice was driving the Ford Taurus that crossed the center line on U.S. 76 and hit a Ford Mustang head-on late Saturday, killing 63-year-old Lois King and 65-year-old Marge Seymore, both of Clinton.

King and Seymore were airlifted to area hospitals, where they later died. A third person in the Mustang was airlifted to a hospital. Rice, who was wearing a seat belt, had to be extricated and was taken to Greenville Memorial Hospital. Four children who were in the Taurus with her also were taken to Greenville Memorial with unknown injuries. None of the children were wearing seat belts, troopers said.

The three women had just left an Elvis impersonator concert at the Newberry Opera House and were two miles away from their destination when the crash happened, she told the TV station. Rice faces up to 25 years in prison on each of the felony DUI resulting in death charges and up to 15 years on each of the felony DUI resulting in great bodily injury charges.
