Dram Shop Liability in South Carolina

“Dram Shop Acts” are state statutes that impose civil liability on barkeepers for the injuries a customer causes to third parties when they knew, or should have known, that such customer was intoxicated when they served him. South Carolina does not have a Dram Shop Act per se, but in Hartfield v. The Getaway Lounge & Grill, Inc., a decision that was rendered on July 26, 2010, the Supreme Court of South Carolina demonstrated that South Carolina can be very forceful in imposing liability on bar owners under other legal theories. One of the owners of The Getaway testified that he did not appear intoxicated while he was there. Although South Carolina does not have a Dram Shop Act, it is illegal in South Carolina to “Knowingly” serve alcohol to any person who is intoxicated. At the time of the accident South Carolina DUI law stipulated that there is a “Permissive inference” that a person was under the influence if that person has a BAC of.10. The Getaway’s liability was predicated on the violation of these two criminal statutes. As Justice Toal stated, “[b]ecause South Carolina does not have a Dram Shop Act, our civil remedy arises out of criminal statutes. The Getaway countered with a number of arguments: that the testimony of the forensic chemist was “Speculative,” that the deceased customer’s fluid samples were obtained in a manner that violates South Carolina’s implied consent laws, that the customer would have had to be “Visibly” intoxicated when he left The Getaway for liability to attach. Finally, the Court noted that the statute that prohibits sales of alcohol to intoxicated persons merely makes it illegal to “Knowingly” sell alcohol to intoxicated persons, there is no requirement that such person be “Visibly” intoxicated. On the basis of these arguments, the Supreme Court upheld the trial court’s $10 million verdict against The Getaway Lounge & Grill and its owners.

SC Solicitor gets a DUI

South Carolina state senator arrested overnight for DUI

South Carolina state senator Paul Campbell was arrested for Driving Under the Influence on Saturday night. According to the South Carolina Highway Patrol, they were called at about 9:15 p.m. to investigate a two-vehicle collision on I-26 westbound, near mile marker 204, in Berkeley County. During the investigation there was a discrepancy in who was driving the at-fault vehicle at the time of the collision. It was determined after talking with both parties of the crash that the driver was Paul Campbell. Campbell was administered a field sobriety test and, as a result of those tests, was arrested for driving under the influence. Campbell was taken to the Charleston County Detention Center and registered a.09 on the Data Master. The passenger in Campbell’s car was his wife and she was charged with providing false information to police. Campbell was booked into the Al Cannon Detention Center at 11:46 p.m. Saturday. Campbell represents portions of Berkeley, Charleston and Dorchester counties. Upon appearing in bond court Sunday morning, Campbell was issued a $992 bond for the DUI charge and a $465 bond for giving false information to police.

Man charged with felony DUI in wreck that killed 9-year-old girl

An arrest has been made in connection with a wreck that claimed the life of a 9-year-old girl Sunday on Interstate 26. Zebulon A. Wright, 46, of Charleston was charged with felony DUI involving death and reckless homicide, according to the South Carolina Highway Patrol. According to Dorchester County Coroner Paul Brouthers, Alivia Watson was thrown from the vehicle she was riding in and died at Trident Medical Center about an hour after she was transported from the scene. The incident occurred around 2:20 a.m. near the 186 mile marker on I-26, troopers said. According to Cpl. Sonny Collins a 2006 Buick and 2004 Ford Explorer were both traveling eastbound on the Interstate when the Buick, driven by Wright, struck the Ford, forcing the SUV off the roadway and over a guardrail, ejecting the child. Highway Patrol is conducting an ongoing investigation.

Driver hits SCHP car, charged with DUI in Charleston Co.

CHARLESTON COUNTY, S.C. – A man is facing DUI charges after an accident involving a South Carolina Highway Patrol State Trooper. Michael Hazel, 28, is charged with DUI second offense. Authorities say just before 2 a.m. on Sunday, January 14, Charleston County Sheriff’s Office deputies responded to Interstate 26 West near Aviation Avenue following the accident. “Based on a preliminary investigation, a Ford F150 driven by Michael Hazel, 28, struck the rear of a stationary marked Dodge Charger on I26,” according to Major Eric Watson. “The State Trooper was not inside the vehicle at the time of the collision and was not injured,” Watson added. Hazel sustained minor injuries and was transported to the Medical University of South Carolina for treatment. He’s since been released from the Sheriff Al Cannon Detention Center.

Dashcam video released of SC state senator’s DUI arrest

The Highway Patrol has released the dash-cam video showing what happened at the scene where state Senator Paul Campbell was arrested for driving under the influence. In the video, you can hear what Campbell says happened. Stories on who was driving Campbell’s car differ. After a failed sobriety test, when Campbell doesn’t perform a heel-to-toe, straight-line walk by the trooper’s standards, he’s cuffed and escorted into the patrol car. Campbell: “I’m sorry to put you through this.”Trooper: “This is my job. No need to apologize.”Campbell: “Well, the lady was just wrong. Vicki jumped out of the car, and I jumped out and said ‘get back in the car.'”. While in the car, Campbell insisted to the trooper he thought he may be at a.03 or.04 blood-alcohol level, because he’d been at a Clemson football party downtown. The dashcam footage of a South Carolina state senator’s arrest on a DUI charge over the weekend has been released by the South Carolina Highway Patrol. The video shows vehicles pulled over after the crash when troopers say Paul Campbell rear-ended a woman in her jeep on I-26. Charleston police officer charged with DUI

CHARLESTON, SC- A Charleston Police officer has been charged with driving under the influence. The Highway Patrol says Cpl. Charles Missel was drunk when he hit a parked car in Charleston early Sunday morning and then left the scene. Missel was arrested Tuesday and charged with driving under the influence and leaving the scene of an accident. Charleston Police officials say Missel has been suspended without pay. A Highway Patrol spokesman says Cpl. Missel was not driving his police issued vehicle at the time of the incident.

Sara Fortier, Charleston Police Department, South Carolina

Count On 2: City of Charleston Police officer charged with DUI after collision. 31 year old Officer Sarah Fortier was driving her police car, a 2007 Crown Victoria, when she she went off the right side of the roadway into a ditch and over-corrected. The SCHP says Fortier drove over to the left side of the roadway and struck the other ditch. Fortier was not wearing her seatbelt at the time and was injured. She was taken to the Medical University of South Carolina.

WEST ASHLEY, SC – A Charleston police officer was arrested over the weekend for driving under the influence. Kate Cloxton was stopped around 11:50 Saturday night near Sam Rittenberg Boulevard. Another Charleston police officer stopped her and South Carolina Highway Patrol later arrested Cloxton. She has since been released from jail but there is no word about her status with the department.

Charleston restaurant sued in DUI case

A Charleston restaurant that was named one of the best new restaurants in the nation last year by Bon Appetit magazine is now being sued in a DUI case. 32-year-old Quentin Miller of Mount Pleasant was killed in a fiery crash on the Ravenel bridge December 17 after his Ford Mustang was rear-ended by Adam Burnell. Burnell is the assistant manager of the restaurant Husk. Now Miller’s family is suing the restaurant, claiming that Burnell was allowed to excessively drink after Husk closed hours before that fatal crash occurred. The lawsuit filed last week claims gross negligence on the part of the restaurant, which is owned by the Neighborhood Dining Group. Neighborhood Dining Group released a statement Wednesday, saying they could not comment on the case due to legal complexities.

Mount Pleasant Tops for DUI Arrests

The Mount Pleasant Police Department has received state recognition for its high number of DUI arrests. The South Carolina Department of Public Safety recognized law enforcement officers and agencies Tuesday for their efforts in 2011 to enforce the state’s DUI laws and remove impaired drivers from South Carolina roadways. Mount Pleasant, which made 411 DUI arrests in 2011, led the state in arrests for departments with 101 or more officers. Officers were given “DUI Angel” awards for their high number of DUI arrests. SCDPS presented awards to officers and agencies in several categories and held drawings for agencies to win equipment and vehicles during a ceremony that combined its 7th Annual DUI Enforcement and 2011 Law Enforcement DUI Challenge recognitions in Columbia.

Will Patton was charged with DUI in South Carolina on Tuesday, Feb. 24, the Associated Press reports. The actor currently stars on the TNT series Falling Skies. Patton, 60, was pulled over while driving his pickup truck on the Isle of Palms. According to an incident report, the star had been veering near the middle of the road. When the officer asked what he had to drink, he responded: “Not too much, a couple bottleser couple of glasses of wine.” Per the AP, the Charleston native failed a field sobriety test; he blew less than 0.10 when the legal limit for driving is 0.08. He also reportedly refused to take a blood alcohol test, and was released on a $997 personal recognizance bond on Wednesday, Feb. 25. Patton is best known for playing Coach Bill Yoast in the 2000 film Remember the Titans opposite Denzel Washington. South Carolina state senator accused of DUI, lying to police

CHARLESTON COUNTY, S.C.- South Carolina Senator Paul Campbell has been arrested for driving under the influence and providing false information to police. According to the South Carolina Department of Transportation the crash happened on Saturday, at 9:15 PM on I-26 near mile marker 204 in Berkeley County. Troopers say Campbell’s vehicle rear-ended another car in congested traffic. When SCDOT arrived on scene, there was discrepancy about who was driving the at-fault vehicle. Troopers determined Sen. Campbell was the driver of the car and administered a field sobriety test. The test registered his blood alcohol level at.09%, the legal limit is.08%. Campbell was arrested for DUI and providing false information to police and booked in the Charleston County Detention Center. Campbell’s wife was also cited for providing false information to police. Campbell is a Republican representing Berkeley County and Chairman of the Senate Ethics Committee. He is also Executive Director and CEO of the Charleston International Airport.

South Carolina DUI laws are a little different than most states. The difference lies in the legal limit for the blood alcohol content of drivers. Drivers who have a BAC lower than.08 can still be arrested for a DUI if there is evidence that they are not able to safely operate their vehicle. For a first DUI offense in South Carolina, a driver with a BAC under. 10 will face a minimum of 48 hours jail time or 48 hours of public service. They will also have to pay a $400 fine, and their license will be suspended for 6 months. 10 and.15 will see their minimum jail time increase to 72 hours. It is possible that the Rhode Island court will allow them the serve 72 hours of community service instead. They will be fined $500 and their license will be suspended for 6 months. 16 will lose their license for 6 months, be fined $1,000, and spend a minimum of 30 days in jail, or complete 30 days of public service.

COLUMBIA – The SC Department of Public Safety recognized law enforcement officers and agencies Wednesday for their efforts in 2012 to enforce the state’s DUI laws and remove impaired drivers from South Carolina roadways. SCDPS presented awards to officers and agencies in several categories and held drawings for agencies to win equipment and vehicles during the 8th Annual DUI Enforcement Recognition and 2012 Law Enforcement DUI Challenge Ceremonies. Additional drawings were held to award 20 digital in-car camera systems. More than 100 agencies received incentive packages for participating in the 2012 Law Enforcement DUI Challenge. Each incentive package consists of two portable traffic barricades, two directional flashing LED mats, five LED flashlights, five micro-digital video cameras and one digital camera. At the ceremony, the following nominated officers were recognized as DUI Heroes. They will receive pins in gold, silver and bronze to honor their DUI arrest accomplishments in 2012. The agency’s mission is to ensure public safety by protecting and serving South Carolina residents and visitors.

South Carolina: Mount Pleasant Police charged Joseph Granger with felony DUI in death of Zachary Grooms

Collision Update: Joseph Granger, 52, from VA has been charged with Felony DUI in connection with the collision on the IOP Connector. On Tuesday, the Charleston County Coroner’s Office identified the victim of the collision as 23-year-old Zachary Grooms of Hanahan. According to the Mount Pleasant Police Department, Grooms was headed toward the Connector Sunday afternoon on a motorcycle when a vehicle turned left off of Riviera Drive into his path. Police say that Grooms struck the driver’s door area of the car and died at the scene. The Grooms/Estep family is asking for your assistance with the funeral expenses for their son Zachary Grooms. Zachary suddenly passed away on Sunday, December 11, 2016, and his family is left with unexpected expenses. Born in Jacksonville, North Carolina on October 27th 1993 to Paul Gilbert Grooms and Clairissa Lynn Estep, Zach had a passion for life second to none. Zach loved the game of tennis and developed quickly into a top player. He loved spending time riding his motorcycle, expressing that he felt so much peace in those moments. North Charleston police officer arrested for DUI

N. Charleston officer says he swerved to miss deer before DUI arrest, wreck. NORTH CHARLESTON, SC – A North Charleston police officer arrested for DUI over the weekend was let go from his job on Monday. According to a spokesperson for the North Charleston Police Department, 25-year-old Nicholas Lomma was driving his work vehicle when the incident happened. Lomma was arrested Saturday morning just before 8 a.m. after South Carolina state troopers found him at the scene of a wreck. Lomma was driving a 2009 Ford Crown Victoria police car at the time of the crash. The incident report says the trooper was working another accident when two North Charleston officers pulled up and asked if he had seen one of their patrol vehicles. The officers were then able to find Lomma, who had apparently crashed his patrol car around 1:30 a.m. Lomma says he was driving when he swerved to miss a deer and he drove into a ditch. The North Charleston Police Department announced Lomma’s departure from the department Monday afternoon. Lomma had been employed with the department since June 2008. Lomma’s bail was posted at $1,000 and he was released from a Colleton County jail over the weekend.

Hundreds of SC county’s DUI cases could be dropped. CAMDEN, SC – Kershaw County already leads the state in DUI deaths, but now hundreds of pending DUI cases in the county could soon be dismissed. “We’re looking at the case file of all the DUI cases pending in Kershaw County,” said Chief Magistrate Eugene Hartis. “It’s approximately 705 cases pending.” “If the officer has left the force and is not coming back, those cases will be called and they will be dismissed,” he said. The judge would not release this list of pending cases, but allowed us to look over the list. We found DUI cases as much as 11 years old still waiting to be heard by a jury. The judge says troopers are making 30 to 40 DUI cases each month for a team of two judges to hear. Hartis says each DUI case, on average, takes about three hours to try. “If I try 10 to 12 DUI cases each week, I still fall behind in those two weeks,” said Hartis. The judge says the imbalance has caused DUI cases to pile up each year, and some say that’s giving the county a bad reputation. The state Supreme Court recently issued an order to magistrates that cases such as DUI must be tried within four months.
