SC ‘Clean, thoroughbred, white girl’ touts career, clean record to avoid DUI

Lauren Elizabeth Cutshaw DUI arrest dash camera vdeo. BLUFFTON, S.C. – In-car audio and dash camera video released Wednesday by police do not contain a South Carolina woman’s now-infamous alleged excuse for why she shouldn’t be arrested and charged with DUI. But the Bluffton Police Department’s video of Lauren Elizabeth Cutshaw’s DUI arrest does show her making desperate pleas to the arresting officer not to take her to jail, for a variety of reasons. Cutshaw, 32, told the officer the night of her Aug. 4 arrest she’d been out celebrating her upcoming birthday before Bluffton police reportedly saw her run a stop sign at 60 mph, prompting the traffic stop. Cutshaw told the officer she had had two glasses of wine that night.

When the officer placed Cutshaw in the back of his patrol vehicle, she seemed in disbelief. During the ride to the police station, Cutshaw, sobbing throughout, repeatedly stresses she has a clean criminal history. The officer tells Cutshaw he would’ve arrested her for reckless driving even if he hadn’t suspected her of DUI. Along with her self-professed spotless criminal record, Cutshaw also points out her apparently stellar academic record and her involvement in extracurricular activities as a student. Cutshaw also later told her arresting officer she had been a sorority girl and a dancer, an incident report shows.

Appeals to her prior track record not gaining traction, Cutshaw is recorded instead pleading to the officer to consider her career and how driving is an integral part of it. Cutshaw even resorts to name-dropping a business partner she claims also is a law enforcement officer. As the police cruiser gets closer to the detention center, Cutshaw becomes inconsolable. It was inside the detention center, after the in-car camera was off, where police say Cutshaw began using her race and gender as excuses to avoid jail.

Teen charged with DUI, child endangerment in deadly SC crash

A 19-year-old South Carolina woman faces DUI and child endangerment charges in a Saturday crash that killed a 17-year-old and injured three others, including two 13-year-old children, according to troopers. The deadly crash happened just before midnight on U.S. 25 near Pine Hill Drive, according to Cpl. Bill Rhyne of the S.C. Highway Patrol. That’s in the Travelers Rest area of Greenville County, about 15 miles north of Greenville.

A 1997 Jeep Cherokee was traveling south on U.S. 25 when the driver, 19-year-old Madison Bagwell of Pickens, lost control of the SUV, Rhyne said. The Jeep went off the left side of the roadway and into the grass median, where it overturned and came to rest in the northbound lanes. Bagwell’s front seat passenger, a 17-year-old woman, was airlifted to Greenville Memorial Hospital, where she later died, Rhyne said. Two of them – a boy and a girl, both 13 and from Pickens – were taken by ambulance to Greenville Memorial Hospital with injuries. A 20-year-old passenger in the back seat also was taken to Greenville Memorial with injuries, Rhyne said.

The three back seat passengers and Bagwell were all wearing seat belts, Rhyne said. Bagwell is charged with one count of felony DUI resulting in death, two counts of felony DUI resulting in great bodily injury, one count of child endangerment and one count of simple possession of marijuana, Rhyne said. Under South Carolina law, felony DUI resulting in death carries a sentence between one and 25 years in prison and a $25,100 fine; felony DUI resulting in great bodily injury carries a sentence between 30 days and 15 years and a $10,100 fine.

Drunk Driving Accident Lawyer Charleston South Carolina

Drivers who are impaired by alcohol or drugs are a danger to everyone around them including other drivers, passengers, pedestrians, bicyclists and even to themselves. If you have been injured in a motor vehicle accident in which the at-fault driver was found to have consumed alcohol, there are claims that may be filed on your behalf other than those against the at-fault driver’s auto insurance and your underinsured motorist insurance coverage. You may also have a claim against a private party, known as a social host, for allowing the at-fault driver to consume alcohol while a minor under age 21. As these claims are highly technical and often require a great deal of resources to prosecute, it is likely in your best interest to seek experienced legal representation to obtain full compensation for all your damages. Unlike some states, South Carolina does not have a specific dram shop act or statute in place regulating this field of tort liability.

Instead, a series of South Carolina Supreme Court decisions cemented our state’s recognition of the moral reprehensibility associated with drunk driving and a willingness to punish all those involved with a terrible act. In these cases, the South Carolina Supreme Court held that establishments licensed to sell alcoholic beverages may be civilly liable for violations of criminal statutes. A) A person engaged in the sale of alcoholic liquors who knowingly sells alcoholic liquors to a person under the age of twenty-one is guilty of a misdemeanor. In South Carolina, any patron with a blood alcohol content greater than 0.08 may be considered intoxicated. At Hughey Law Firm, our team of lawyers uses any and all available resources to discover the extent of your claim, including accident re-constructionists, private investigators, dram shop liability expert witnesses, medical experts, and more.

Since our attorneys work on a contingency fee basis, we will front the costs to prosecute your claim and won’t recoup these costs unless we are able to recover a monetary award from the at-fault parties or their insurance companies. Our lawyers have all the necessary experience to effectively prosecute all of your claims to the fullest extent of the law to obtain a just reward for your injuries suffered as the result of a drunk driving auto accident.

DUI Resources

The DUI law underwent a significant change effective February 10, 2009. Anyone convicted of DUI prior to that date faced the exact same consequences no matter what the evidence showed. In all first offence DUI cases the penalty exposure was a fine of $997 or a jail sentence of a minimum of 48 hours up to a maximum of 30 days. Effective February 10, 2009 the penalty range was expanded to provide for a jail sentence of a minimum of 30 days and a maximum of 90 days in the case of a DUI or DUAC first offence where the BAC is a.16 or greater. My DUI Penalty Chart lists the direct sentencing consequences for those convicted of DUI in South Carolina.

The lawyer’s preparation can’t start with your case. An effective DUI Defense lawyer has to understand the evidence used to prosecute DUI cases. The best DUI Defense lawyers know the science and law of field testing, breath testing, blood testing, and urine testing. DUI trial lawyer Drew Carroll has completed the same training program on the administration of Standardized Field Sobriety Tests that DUI enforcement officers are required to complete. Drew Carroll has both been trained and trained other defense lawyers on the science of breath-testing and the operation of the DataMaster/breathalyzer.

In addition to breath-test training and experience, Drew has also received extensive training on challenging blood and urine test result evidence in DUI cases. He has successfully defended cases involving every type of scientific evidence used to prosecute DUI cases.

If the DUI is dismissed, the charge will be automatically expunged. In the event you have multiple DUI’s within a 10 year period, and the officer still charged you with DUI 1st offense, there is a chance the charge is enhanced to the appropriate level based on prior convictions. Requesting that hearing must be done within 30 days of the arrest, and will make you eligible for a temporary driving privilege. Every job is different, and some require a duty to report arrests and/or convictions. It is important to speak with a DUI lawyer about your specific employment to determine what you are required to disclose to your employer.

If your home state finds out about the arrest and/or conviction, they may impose their own suspension on your license. It is important to consult with a DUI lawyer before doing anything, as it may be advantageous to wait before doing anything until you know more about your case. You may still be arrested for DUI in a parked car if there is other evidence that you were recently driving. DUAC merely requires proof that you were driving with a BAC above 0.08. It is not necessarily illegal to drive after consuming alcohol and/or medication unless the State can prove you were impaired.

In the event you’re arrested for DUI after consuming alcohol and/or medication, the burden is on the State to prove impairment. This allows for a DUI lawyer to review those videos to determine if the officer was correct in his belief.

Can a DUI be Expunged in SC?

DUI convictions can NEVER be expunged from your record. Simply put, an expungement is a legal process that results in a court order directing those public entities having records of your arrest to destroy them. Obtaining a SC expungement means that the record of your arrest will be deleted from law enforcement and other public databases. Getting a charge expunged involves pursuing a court order directing the expungement or destruction of your arrest records. You can have a DUI charge removed from your record if.

You CAN’T have a DUI charge expunged from your record when. If you were charged with DUI and then found guilty or you pled guilty, these convictions will stay on your criminal record forever. Yes! If you were charged with DUI, and you were found not guilty, you can get the DUI charge expunged. Beyond questions about whether or not a charge can be expunged, our clients tend to ask similar questions about scrubbing their criminal records.

A lawyer who has experience getting charges expunged can do it for you and therefore save you the time and stress. An expungement usually costs around $300. But for DUI charges, expungements are free because fees are waived when you’re not guilty or not prosecuted. An internet industry has arisen that obtains records of arrests and sells this information to national databases and convenience store magazines.

Felony DUI Involving Death

Act Quickly! Your Life Depends On It! If you are involved in an auto accident that resulted in the death of a person and are believed to be under the influence of alcohol or drugs, you may be charged with Felony DUI with death. When faced with a felony DUI with death charge, the consequences are extraordinarily serious and the penalties carry mandatory minimum jail time of one year and as many as twenty-five years in State Prison if convicted! In addition to the criminal penalties, if convicted of Felony DUI with Death, the Department of Motor Vehicles must suspend your driver’s license for the period of incarceration plus five additional years.

ACT QUICKLY TO PREPARE A DEFENSE: There is a very limited time frame to develop a compelling defense on Felony DUI death charges. Police arriving at the accident scene evaluate the severity of the injuries and will often call in their own experts to reconstruct the accident. Felony DUI cases are normally investigated by the SC Highway Patrol’s accident investigation team, known as MAIT. MAIT is the Multi-Disciplinary Accident Investigation Team that assists law enforcement agencies, and they normally provide in-depth investigations and/or reconstructions to determine the exact events of the collision. MAIT’s ultimate objective is to be the fact finders so decisions can be made as to the charges and causes of an accident.

A conviction for Felony DUI involving death requires the Defendant to actually serve eighty-five of the prison sentence. We can employ our own experts to examine the accident scene, look at the car damage and interview witnesses. We routinely employ former traffic supervisors as case analysts who themselves have investigated accidents involving felony DUI during their careers as law enforcement officers. We utilize the services of veteran accident re-constructionists who have retired and are now working independently as experts in their fields. Their expertise combined with our experience in defending felony DUI arrests creates a highly capable defense team to work for you.

Arrested for DUI in Charleston, Berkeley or Dorchester?

If your vehicle has been towed, you will need to follow the local arresting agency’s particular policy for the release of any vehicle. Often times, officers from multiple agencies, such as local deputies and state troopers will play separate rolls in an arrest and documents don’t get passed along. We prefer to meet with each client individually and gather a very, very detailed description of the events before, during and after the arrest. Please realize that we know exactly how an officer should handle a DUI arrest in particular circumstances, whether it be a traffic stop, a checkpoint, a single or multi-car accident. We are often looking for things that you or your witnesses can either confirm took place or deny, which are extremely important to an arrest.

This is why you need an experienced DUI attorney who has handled hundreds of DUI arrests. Remember, the police report is the Arresting Officer’s version of the events of the evening. Police officers will include most everything that supports their arrest and very little or nothing favorable to the Defendant. The requirements and law regarding the sequencing of events during an arrest are constantly being refined and further detailed by the South Carolina Courts. Once retained, we will also serve the Arresting Officer and each agency involved with a Discovery Motion designed to examine any and all evidence they intend to use against you in their prosecution of the DUI charge.

Remember, each and every DUI Arrest is different and each client’s dialogue which is caught on police video and recorded is different. Each individual arrest is different from any other, with differing officers, agencies, facts, evidence and witnesses.

Violations of SLED policy and procedure for breath tests or blood tests;. Maintenance issues with the Datamaster machine that you were tested on. If you were not driving at the time of the alleged offense, you are not guilty of DUI. Imagine what may seem like a worst-case scenario to some people: You get hammered at a bar. Police arrive and find you behind the wheel in the driver’s seat.

Unless you admitted to driving or the state has another witness who can testify that they saw you driving, they cannot prove the first element of driving under the influence in SC – that you were driving. Sobriety is Always a Defense to DUI. Obviously, if you were not intoxicated to the extent that your faculties to drive were materially and appreciably impaired, you also should not be convicted of DUI. Whenever possible, we can present sobriety witnesses to testify as to their observations and your ability to drive. The potential defenses to DUI charges in SC are too numerous to list on a webpage, and the defenses in your case will depend entirely on the facts of your case.

On June 2nd, a bill was signed into law that will stop the solicitor’s offices from charging a fee to expunge records where the person was found not guilty or where the charges were dismissed. In exchange for an expungement service that is provided by the solicitor’s office, the applicant is responsible for payment to the solicitor’s office of an administrative fee in the amount of two hundred fifty dollars per individual order, which must be retained by that office and used to defray the costs associated with the expungement process, except as provided in subsection. The two hundred fifty dollar fee is nonrefundable, regardless of whether the offense is later determined to be statutorily ineligible for expungement or the solicitor or his designee does not consent to the expungement. B) Any person who applies to the solicitor’s office for an expungement of general sessions charges pursuant to Section 17-1-40 is exempt from paying the administrative fee, unless the charge that is the subject of the expungement request was dismissed, discharged, or nolle prossed as part of a plea arrangement under which the defendant pled guilty and was sentenced on other charges. This bill decreases the time limit for an expungement under the Youthful Offender Act from 15 years to 5 years.

DUI and video tape in South Carolina…a recent case.

Many people in South Carolina are unaware of a specific law here which requires that all DUI arrests be videotaped. This is because sometimes defendants are accused of crimes they have not committed, and a videotape is helpful in showing what the police saw at the time of arrest. It is also helpful for police, because they are occasionally accused of improper actions or faulty investigations, and the tape will show if they have acted properly. A recent South Carolina Court of Appeals case is helpful to shine a light on this statute and how important it is in DUI law. The arrest was not videotaped due to faulty equipment in the officer’s car.

With the rewording of the statute, the state now requires officers to indicated which specific measures were taken to make the camera operable. Cases have been tried which directly deal with this provision. The legislature meant for it to be that strong, to protect both defendants and police alike. A DUI case is a serious matter, and may not seem like it, but it is an intricate case that can have long range repercussions on your ability to work or drive. At the very least, know that if you get pulled over, you are being recorded and should act accordingly.

Help with South Carolina Parking Tickets, Speeding Tickets, DUI Violations & Ticket Attorneys

Following the rules of the road is the most important part of driving. In the state of South Carolina, you must follow all national and state driving laws. When you commit a violation, you may be issued a ticket, which can carry a hefty fine. You may be able to reduce a ticket or have a violation expunged from your record. We’ve all made the mistake of speeding at some point.

Depending on how fast you go, the cost of a speeding ticket can grow exponentially. There may not be a more serious driving violation than DUI. It’s costly not only from a financial perspective but also from a safety one. Just because you get a ticket doesn’t mean it’s the end of the world. A ticket attorney may be able to prevent points being assessed on your license.

A DUI is an extremely serious offense that carries even more serious consequences. You may be able to lessen the charges by hiring a reputable DUI attorney. SR-22 insurance is reserved only for people who are very high-risk drivers.

Charleston DUI Lawyer News for 05-17-2018

dui.presidentshalloffame.com

At this juncture, your situation may seem quite dire, and it is highly likely that you fear permanent negative changes in your life, but hiring a Williamson, West Virginia DUI or DWI Lawyer may calm your anxiety due to your decision to drink and operate a motor vehicle. It’s probably been less than ten days since you were arrested, and therefore you still have time to take action that can enhance your prospects in the near term. As a starting point, you get the ability to appeal your license suspension and seek a hearing to which you are entitled, but about which you were not explicitly and clearly informed. Specific jurisdictions supply seven days for such an appeal, others provide ten days, but in spite of the time line, it is critical to get in touch with the DMV as soon as you can. In the event you have already consulted with an attorney, this could have been one of the initial questions he or she asked, as it can have a substantial long term impact on your case.

Should you fail to pursue this course of action and the deadline has passed, it is possible that you will have lost your driving privileges for a great deal of time, depending on your jurisdiction. In instances where the license has been lost, it might be possible to request hardship driving privileges, though it will be necessary to demonstrate that you would have absolutely no other way to reach school or work if you were unable to drive. People who are not attorneys focusing in this area of the law are unlikely to be very knowledgeable about West Virginia DUI law, though lawyers focusing on DWI cases are very familiar with the sorts of errors that can be made by arresting officers, and how such mistakes can benefit their clients. Attorneys who routinely practice in this branch of the law will be able to secure any video documentation of the arrest, determine whether the Williamson, WV arrest itself was valid and lawful, and will know how to attack the credibility of any field sobriety tests. The concept of probable cause might be a great boon to your prospects, as a valid arrest requires that the officer had a good reason for having pulled you over, such as failure to obey traffic signals or swerving.

This is no different, the consequences of failure could be grave, so make sure you secure the best counsel you can going forward, if you don’t, you might regret not doing so for a long time to come.

Charleston South Carolina SC. This 60-acre park next to The Citadel in downtown Charleston is encircled by Mary Murray Drive, a two-lane road which follows the historic Washington Race Track. The former racecourse was established in 1792 by the South Carolina Jockey Club, whose elite members included General Charles Cotesworth Pinckney, delegate to the Constitutional Convention of 1787; General William Moultrie, South Carolina governor and Revolutionary War hero; and Wade Hampton, governor during Reconstruction, United States senator, and namesake of this park. In 1899 the club voted to disband, and the property was deeded to the Charleston Library Society. The purpose of the expo was to showcase Charleston in hopes of luring new industries to the city.

Though the South Carolina Inter-State and West Indian Exposition was not widely viewed as an economic success, the American Cigar Company, the United Fruit Company, and an oyster canning company established businesses in Charleston as a result of the fair. When the City of Charleston sold Chicora Park in North Charleston to the Navy Yard in 1901, it used the proceeds to purchase the former race course following the close of the expo. The park is closed to traffic, creating a safe haven for walkers, runners, and cyclists to enjoy the outdoor beauty of Charleston. You will consult with the lawyer who is going to handle your case from start to finish. We want to meet you and want you to meet your lawyer.

DUI Checkpoints

Police in most states occasionally set up DUI checkpoints to check for drunk or otherwise impaired motorists. Typically, police set up these checkpoints along busy highways during holidays that are notorious for alcohol abuse, such as 4th of July and Memorial Day. Checkpoints usually consist of roadblocks along intersections, where officers stop random vehicles at regular intervals and check for signs of intoxication. While DUI or sobriety checkpoints remain controversial and are prohibited in some states, federal law supports their legality. Learn more about this common law enforcement practice below, and see FindLaw’s DUI Stop section for related articles.

Sobriety checkpoints have survived most legal challenges, even in some states where statutes require an officer to have reasonable suspicion of intoxication before initiating a traffic stop. The challengers in the case had claimed that these checkpoints were unreasonable searches under the 4th Amendment, but the Court found them reasonable under the circumstances. Checkpoints reduce alcohol-related crashes by about 20 percent, according to a U.S. Centers for Disease Control report combining the results of 23 scientific studies. While federal law condones checkpoints for the purpose of maintaining safer roadways, states are free to decide whether or not to use them.

If you or a loved one are arrested for impaired driving, you may need an experienced DUI DWI lawyer. A skilled attorney who specializes in defending drunk driving charges will evaluate all the evidence, including the legality of a DUI checkpoint, to ensure that your legal rights are protected. To learn more, it’s in your best interests to contact an attorney in your jurisdiction for a free evaluation of your DUI case.
